Are your foreclosed properties in violation of the Florida Department of Environmental Protection’s (FDEP) National Pollutant Discharge Elimination System (NPDES) Permit and one of Florida’s five Water Management District’s (WMD) Environmental Resource Permit (ERP)?
Failure to comply could result in large fines,
even if you have halted construction.
This includes:
- Any single project land disturbance activity greater than 1 acre
- Any land disturbance activity less than 1 acre that is part of an overall development
- Any construction project that will affect wetlands, alter surface water flows or contribute to water pollution
Incomplete construction activities must still comply with BOTH permits and are subject to:
- Routine inspections
- Maintenance of any temporary erosion control structures
- Subject to fines by both the FDEP and WMD, if non-compliant
